You are not permitted to publish, or produce, any of the content or copies of the content supplied to you or which appears on this Website.

TERMS OF SALE

By placing an order you are offering to purchase a product and subject to the following terms and conditions. All orders are subject to availability and confirmation.

Dispatch times may vary according to availability.

In order to contract with Zoom & Bloom by Alex you must possess a valid credit or debit card issued by a bank acceptable to us.

If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.

All prices advertised are subject to changes.

a. Our Contract

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card.

b. Pricing

All transactions are processed in Australian Dollars (AUD) and include a Goods and Services Tax (GST) of 10% unless otherwise specified. All prices displayed on the Website are subject to change without notice, including offering promotional, discount or higher prices. The valid price at any time is that which is published on the Website at the time of purchase. Prices on the Website may differ from those published elsewhere and by third parties.

In the event that a product is listed at an incorrect price or with incorrect information due to typographical error or otherwise, Zoom & Bloom by Alex may refuse to fulfill or cancel any orders placed for such products listed at the incorrect price, whether or not the order has been confirmed or you have been charged in part or full for the order.

Zoom & Bloom by Alex has the right to vary price at their sole discretion, including but not limited to an offer for wholesale price for purchase. Any offer for wholesale price will be confirmed in writing by Zoom & Bloom by Alex (email is acceptable).

c. Product appearance

Zoom & Bloom by Alex makes every effort to ensure that products are displayed as accurately as possible on the website; however, Zoom & Bloom by Alex does not warrant that the product descriptions, images, or prices are accurate. The actual color of products may differ from how they appear on your screen, as monitor colors can vary significantly. Additionally, paper stock may vary from product to product and may contain imperfections. Zoom & Bloom by Alex believes that such imperfections add to the character of its products, meaning no two items will be 100% identical.

c. Framing

Zoom & Bloom by Alex offers printing and framing services through affiliated third-party providers. While Zoom & Bloom by Alex makes every effort to ensure that these services are completed to a high standard, it does not warrant or make any representations regarding the quality of the products or services provided by the third parties.

d. Payment

Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.

Payment must be made in full at the time of online order. Zoom & Bloom by Alex utilizes the services of third parties, including PayPal, to process payments on the website. You are responsible for making your own inquiries and abiding by the terms and conditions of use of the relevant third-party payment processing entities. All inquiries or issues related to payment processing must be directed to the respective third-party payment processing entity. In no event shall Zoom & Bloom by Alex be responsible or liable for any payment processing issue or error. Zoom & Bloom by Alex will not be responsible for any damages or consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or used in an unauthorized manner.

TERMINATION OF ACCOUNT

Zoom & Bloom may suspend or terminate your access to all or any part of the zoom & Bloom Services or your account at any time, with or without cause, with or without notice, effective immediately. You may terminate these Terms at any time by terminating your use of the zoom & Bloom by deleting your account.

GENERAL LAW & JURISDICTION

These Terms shall be governed and construed in accordance with the laws of the State of New South Wales, Australia and you irrevocably submit to the non-exclusive jurisdiction of the Courts of such State in resolving any disputes.
